Pulsate Events – Equipment Hire Terms & Conditions
1. Definitions
- “Company” refers to Pulsate Events.
- “Hirer” refers to the person or entity entering into the hire agreement.
- “Equipment” refers to all items supplied by the Company.
- “Hire Period” means the agreed duration from delivery/collection to return.
2. Acceptance of Terms
- By confirming a booking, the Hirer agrees to these Terms & Conditions.
- These Terms apply to all equipment hire and services unless otherwise agreed in writing.
- The Company reserves the right to update these Terms at any time.
3. Bookings, Payments & Bond
- A booking is confirmed only once full payment has been received, which includes a 10% non-refundable deposit.
- Full payment must be made prior to the scheduled delivery or collection date unless otherwise agreed in writing by the Company.
- The Company reserves the right to require a security bond, which is refundable upon the safe return of all Equipment in accordance with these Terms. The Hirer will be notified of any bond requirements prior to booking confirmation.
- The Company may retain part or all of the bond to cover any damage, cleaning, late return fees, or breaches of this agreement.
4. Hire Period
- The Hire Period begins upon delivery, setup, or collection and ends when Equipment is returned or collected.
- Late returns or extended use will incur additional charges at standard hire rates.
5. Use of Equipment
The Hirer must:
- Use Equipment strictly in accordance with instructions
- Ensure competent and supervised operation
- Not modify, repair, or tamper with Equipment
Certain Equipment (e.g. DMX lighting, cold sparks, special effects) may require:
- A Company operator, or
- Prior written approval for use
- The Company may refuse hire if Equipment is deemed unsafe to operate by the Hirer.
6. Power & Site Requirements
The Hirer must ensure:
- Safe and sufficient power supply
- Suitable venue access and setup conditions
- Compliance with all venue and electrical requirements
- Any damage caused by improper power supply is the Hirer’s responsibility.
7. Equipment Care & Risk
- The Hirer is responsible for Equipment for the entire Hire Period.
- Equipment must be protected from:
- Weather (rain, moisture, wind)
- Dust, liquids, and misuse
- Theft or unauthorised use
- Equipment must not be left unattended in unsecured environments.
8. Loss, Damage & Theft
- The Hirer is liable for:
- Full replacement cost for lost/stolen Equipment
- Repair costs + loss of income for damaged Equipment
- Theft must be reported to Police immediately with documentation provided.
9. Delivery, Setup & Collection
- Delivery, setup, and pack-down are included unless stated otherwise.
- The Hirer must provide clear and safe access.
- Delays caused by the Hirer may incur additional fees.
- Equipment installed by the Company must not be moved or altered.
10. Safety & Right to Refuse Service
The Company may:
- Refuse delivery or setup
- Suspend or terminate hire
- if conditions are unsafe (e.g. weather, crowd risk, power issues).
- No refunds will be issued where safety concerns prevent operation.
11. Cancellations & Refunds
- More than 7 days notice → 75% refund (excluding deposit)
- Within 7 days → up to 100% charge applies
- Deposits are non-refundable.
- No refunds for events impacted by:
- Weather
- Power failure
- Venue or third-party issues
12. Liability & Indemnity
- The Hirer accepts all risk associated with use of Equipment.
- The Hirer agrees to indemnify the Company against:
- Injury
- Death
- Property damage
- Legal claims
- arising from use or misuse of Equipment.
13. Limitation of Liability
- To the maximum extent permitted by law, Pulsate Events’ liability is limited to:
- The Company is not liable for:
- Indirect or consequential loss
- Loss of profits, event disruption, or reputation damage
14. Insurance
- The Company holds public liability insurance.
- The Hirer is strongly advised to obtain:
- Event insurance
- Public liability insurance
- Insurance is not provided for dry hire unless explicitly stated.
15. Force Majeure
- The Company is not liable for failure or delay due to:
- Weather
- Natural disasters
- Government restrictions
- Supplier or transport issues
16. Event Planning Services
- A separate written agreement will govern all event planning services.
- Planning deposits are non-refundable.
- Additional work or scope changes may incur extra costs.
- The Hirer remains responsible for permits and legal compliance unless agreed otherwise.
17. Intellectual Property
- All creative content remains property of the Company until full payment is received.
18. Governing Law
- This agreement is governed by the laws of New Zealand.
19. Agreement
- By confirming a booking, the Hirer confirms they have read and agreed to these Terms.
